Partner Assignments: Wesley: Questions 1-5
Sofia: Questions 6-10 and Extra Facts To Help Understand the Constitution 1 Why was this amendment created? The reason this amendment was created was to further the rights of the people by allowing anyone who was born in the USA to be a citizen, no matter their race. This allowed for an influx of citizens after the civil war, which had just ended when this amendment was created. This amendment says that to government can infringe on any citizen's right to life, liberty and their pursuit of happiness. Blacks and women didn't get the right to vote until later, however. http://www.americaslibrary.gov/jb/recon/jb_recon_revised_1.html (written by Wesley) 2 What problem did this amendment address? This amendment addressed the amount of people who had been freed from slavery that were not officially regarded as citizens. African-Americans needed to become citizens after their freeing from slavery, so that they do not have their rights as people infringed again. With more people in the normal population, there would be more poverty and other problems in the economy without their citizenship so a new amendment had to be created to address this.
(written by Wesley) 3 When was this amendment created? This amendment was created on July 28, 1868. As I stated before it was created soon after the freeing of the slaves at the end of the civil war so that African Americans would be included in society.
(written by Wesley) 4 Which political party favored this amendment most? At this time when this amendment was ratified, the parties that were on the left and right were reversed. The democrats were conservative, and the republicans were liberal. Therefore, the republicans highly favored this amendment because of their liberal attitude. In 1868, in the 39th congress, the house and the senate were both republican-controlled. The amendment won out because the republicans had more votes.
(written by Wesley) 6 How could a state/the Federal Government make a law that would take away privileges and rights granted by the fourteenth amendment?
The federal government could easily make a law denying rights and privileges from the fourteenth amendment. For example, they could create a law denying foreigners a way to become naturalized (also called citizenship process). This would violate section one. A state could make a law excluding a certain race/group from the right to a lawyer or the right to trial.

7. Why do you have to be naturalized to vote?
The first reason of why you have to be American to vote is because it is a privilege in America. Also you have to be an American citizen to vote because if someone was here on a visa, and they could vote, it would not represent the needs of the people of America, but instead the needs of the people of America and the foreigners. http://www.history.org/foundation/journal/spring07/elections.cfm

The reason you had to be a white male to vote was because the founding fathers thought it would be dangerous to allow everyone to vote. In fact, during this time, democracy was considered a bad form of government. Because of this, they decided to select only a certain group of people allowed to vote, and naturally they chose white men because of the sexism and the belief that african-americans were inferior. http://www.history.org/foundation/journal/spring07/elections.cfm

Amendment fourteen is one of the most important Amendments. This is because it protects citizen's natural rights, the natural rights are life, liberty, and property which originated from John Locke. Also, Amendment fourteen provides equal protection to everyone (that is, if you're a citizen.) In the Amendment there are five sections, in the first section it regards the Constitution. It regards the Constitution because it is forming a basics for landmark decisions. The second section refers to rebellion and crimes and this has to do with the Constitution since this has been pleading for a Constitutional ground. Lastly, in Amendment fourteen it states that Indians are excluded from citizenship, it also says something along the lines of this in the Constitution. https://en.wikipedia.org/wiki/Fourteenth_Amendment_to_the_United_States_Constitution\

Indians were excluded from the population, they weren't taxed either and they basically weren't a citizen. The drafters of the fourteenth Amendment stated that tribal Indians were Indians that weren't taxed. There are many arguments that prove that the Amendment restrictions against tribal Indians not being taxed were proves to be unconstitutional. Furthermore they were excluded because they were "not taxable." However they are "not taxable" as long as they remain a subject to their own jurisdiction. http://eric.ed.gov/?id=EJ751642

5 How would a person from another country become a citizen under this amendment?
The way someone would become a citizen who was not born here is that they would have to go through the citizenship process. This process is complicated and takes at least 5 years. This process is the process of being "naturalized" so that people can be considered a citizen. The first step in this process is to complete paperwork. Then, you have to get a physical. After this, they complete an interview and then pledge their oath of allegiance to the USA.
