\nIt was created because the colonies had a bad experience with Britain and its monarchy. Habeas Corpus also plays into the 5th Amendment because it states you have the right to a trial by jury.

\nIt is fair because you cannot be tried twice for the same crime. Double jeopardy is a legal rule that works to stop an accused person being charged with the same crime again, after they've already been accused of the crime. Having no double jeopardy is important because when the English had an empire and were in the Americas, they would put someone on trial for no reason. If the courts were good, then, they would declare the person innocent. However, every time the person was found innocent, the British authorities would move them to different courts. They would do this as many times as it took for the person to be found guilty. In order to avoid this problem, Amendment 5 says that double jeopardy is illegal.
